1. Introduction
These Terms & Conditions (“T&Cs;”) form an integral part of any warranty issued by Balmore Group Scotland Ltd (“Balmore”) for roofing, guttering, coating, lightning protection, or associated works. By accepting a warranty certificate issued by Balmore, the Client acknowledges and agrees to these T&Cs.;
2. Definitions
“Balmore”: Balmore Group Scotland Ltd and its trading divisions.
“Client”: The organisation or individual to whom the warranty certificate is issued.
“Works”: Roofing, guttering, lightning protection, coatings, or associated systems installed by Balmore.
“Warranty”: Any workmanship and/or material guarantees issued by Balmore and/or associated manufacturers.
3. Scope of Warranty
Balmore warranties apply only to the Works detailed in the corresponding warranty certificate. Where a manufacturer warranty applies, coverage is subject to the manufacturer’s own T&Cs.; Balmore does not warrant any materials, products, or systems outside the stated scope.
4. Conditions of Warranty
To maintain validity, the Client must:
1. No alterations to approved designs, details, materials, or system terminations without prior written consent from Balmore.
2. No maintenance, repair, inspection, or alterations by any contractor not pre-approved by Balmore.
3. Follow all manufacturer-recommended maintenance schedules, including inspections (e.g. six-monthly gutter cleans).
4. Notify Balmore in writing within 14 days of any defect, failure, or performance issue.
5. Ensure full payment for all Works and associated invoices has been received by Balmore.
5. Warranty Exclusions
This warranty is void if:
– Any third-party carries out unauthorised works, alterations, or penetrations.
– Approved design specifications are modified without written consent.
– Safety-critical systems (e.g. lightning protection) are installed or altered by non-accredited contractors.
– The Client fails to follow required maintenance schedules or manufacturer instructions.
– Damage arises from misuse, neglect, impact, or unrelated third-party activity.
6. Defects Liability Period (DLP)
Where a DLP is stated in the warranty certificate, it covers defects in Balmore’s workmanship only. The DLP will automatically terminate if:
– Third parties open, alter, or interfere with the Works,
– Approved designs are modified without consent,
– Non-approved contractors perform related scopes, especially on compliance-controlled sites (e.g. Scottish Water assets).
7. Manufacturer Warranties
Manufacturer warranties are subject to their own conditions. If unauthorised modifications compromise these warranties, Balmore accepts no liability for rejected claims. Balmore may, at its discretion, liaise with manufacturers on the Client’s behalf but provides no guarantee of approval.
8. Compliance-Controlled Sites
For works on regulated assets (e.g. Scottish Water sites), Balmore warranties remain valid only where works are performed by Balmore or a pre-approved contractor. Use of unapproved contractors may immediately void Balmore’s warranties.
9. Limitation of Liability
Balmore’s liability under any warranty is strictly limited to:
– Repairing or replacing the defective Works; or
– At Balmore’s discretion, refunding the original cost of the Works.
Balmore is not liable for consequential or indirect losses, downtime, business interruption, or third-party claims arising from unauthorised works or misuse.
10. Governing Law
These T&Cs; are governed by the laws of Scotland, and any disputes shall be subject to the exclusive jurisdiction of the Scottish courts.
